Data Protection

Data protection is about your fundamental right to privacy. KCETB has always kept, and will continue to keep, your personal information safe and confidential.

The EU General Data Protection Regulation (GDPR) came into effect on 25th of May 2018. It gives people more rights, control of and understanding of how their personal data is being used.

GDPR does not affect the services we provide but does require us to keep you informed about:

  • the type of data we hold about you
  • the purpose of this data
  • your rights in relation to how your data is processed.

The following links provide information on our Data Protection Policy. Information on how we process your data is outlined in the Data Privacy Notices.

We share and transfer student data to other data controllers. In this section we give you further information about the types of recipients or categories of recipients of your personal data. Please note that this list is not exhaustive, and we will transfer personal data to other third parties where required or permitted by law. Furthermore, please note that the ETB reserves the right to contact appropriate third parties in the event of an emergency.

The ETB also shares and transfers personal data to its legal advisors to obtain legal advices and for the taking and defending of legal claims
  • Service providers (CCTV, security, IT support, payments solutions platforms, direct marketing agencies or printing companies, plagiarism detection services/software, service providers delivering services to students, e.g. Apps, Tablets etc). To obtain appropriate expertise and support, and to ensure that the ETB is being properly managed. These service providers shall be retained pursuant to a written [Service Level Agreement/Data Processing Agreement]

This is an indicative list of the bodies to whom we transfer data, but it is not an exhaustive list. We will disclose to other third parties (who are not necessarily listed here) where there is a legal basis, and/or we are legally required to do so.

Under data protection legislation, a data subject has the following rights: 
  • right of access
  • right to rectification
  • right to be forgotten
  • right to restrict processing
  • right to data portability
  • right to object and to object to automated decision making /profiling
  • right to complain to the Supervisory Authority
A data subject can request access to copies of their data held by KCETB in any of its administration offices, schools, or colleges of further education by emailing the request to dataprotection@kcetb.ie, or writing to KCETB, Seville Lodge, Callan Road, Kilkenny. A Data Access Form is also available on request from dataprotection@kcetb.ie. The person making the data access request must provide one of the following to verify identity:
  • an up-to-date passport or drivers licence officially verified with the station stamp and signature of a member of An Garda Síochána
  • a declaration from a Commissioner of Oaths verifying identity
  • presentation in person of formal identification at the administration office of KCETB, Seville Lodge, Kilkenny
The requester must outline the nature of their association with KCETB. CCTV image requests must include the exact location, date and approx. time within 28 days of an incident (we do not hold footage after this time). In certain circumstances, and in accordance with the Data Protection Legislation, a request may be refused. In such an instance, KCETB will provide the data subject with a full legal basis for refusal. Upon receipt of all relevant documentation, KCETB will process the request within 30 calendar days. In accordance with data protection legislation, KCETB can only release data relating to the person making the data request. Data relating to any other individuals will be redacted where necessary. CCTV footage will be pixilated to protect the identifiable data/images of all other parties. More information on privacy in relation to CCTV can be found in our CCTV Policy and Privacy Notices.

Parents/Guardians making a Data Access Request for copies of data held about their child (student under 18 years) should read and familiarise themselves with the data protection laws surrounding their requests. Section 3, (3.1 (a), (b) and (c)) of KCETB’s Data Protection Policy outlines this process within KCETB schools and centres.
