The requester must provide sufficient information to assist in locating their records, including: date of birth, current and previous addresses, contacts with our services and approximate dates. KCETB will need to verify by appropriate means the identity of an individual and proof of identity may be requested. The following is a summary of the new fee structure in respect of non-personal requests: \u2013<\/p><ul><li>The \u20ac15.00 application fee has been abolished;<br \/>There is a minimum threshold of \u20ac101 below which no search, retrieval and copying fees can be charged.\u202f\u202f Once the charge reaches \u20ac101, full fees apply;<\/li><li>There is a cap on the amount of search, retrieval and copying fees that can be charged of \u20ac500;<\/li><li>There is a further upper limit on estimated search, retrieval and copying fees at \u20ac700.00 above which an FOI body can refuse to process a request, unless the requester is prepared to refine the request to bring the search, retrieval and copying fees below the limit;<\/li><li>The fee for internal review under Section 21 is now \u20ac30.00 (\u20ac10.00 for medical card holders and their dependants);<\/li><li>The fee for appeals to the Information Commissioner under Section 22 is now \u20ac50.00 (\u20ac15.00 for medical card holders and their dependants).<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0f29bd3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0f29bd3\" data-element_type=\"section\" data-e-type=\"section\" id=\"free-sec11\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-45b51b6\" data-id=\"45b51b6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-adaa85c elementor-widget elementor-widget-heading\" data-id=\"adaa85c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Information Commissioner<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-66272c8 elementor-widget elementor-widget-text-editor\" data-id=\"66272c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The main functions of the Information Commissioner can be summarised as:<\/p><ul><li>The review (on application) of the decisions of the public bodies in relation to FOI requests and where necessary, the making of binding, new decisions;<\/li><li>The review of the operation of the Freedom of Information Act 2014 to ensure that public bodies comply with their provisions;<\/li><li>The fostering an attitude of openness among public bodies by the encouragement of the voluntary publication of information above and beyond the minimum requirements of the Acts;<\/li><li>The preparation and publication of commentaries on the practical operation of the Acts; and<\/li><li>The publication of an Annual Report.<\/li><\/ul><p>The Data Protection Acts provide similar rights of access as the FOI Acts, the main difference being that the Data Protection Acts do not apply to records of deceased persons. As with the FOI Acts, these rights extend to an individual\u2019s own personal records and in specific circumstances, to those of their children. There are exemptions provided for in the Acts, this means that there are specific circumstances when the requested information will not be released. If any of these exemptions are used to withhold information, the reasons will be clearly explained to you.<\/p><p>Data Protection is the safeguarding of the privacy rights of individuals in relation to the processing of personal data. An individual supplies information about themselves to many organisations, including the Kilkenny and Carlow Education and Training Board (KCETB) in order to avail of services or satisfy obligations.\u202f\u202f For the purpose of Data Protection, such organisations or individuals who control the contents and use of personal data are known as Data Controllers.<\/p><p>Kilkenny and Carlow Education and Training Board, as a Data Controller must adhere to the eight rules of Data Protection. The eight rules, which apply whether the information is held on a computer or in a manual form, are:<\/p><ul><li>Obtain and process information fairly;<\/li><li>Keep it only for one or more specified, explicit and lawful purposes;<\/li><li>Use and disclose it only in ways compatible with these purposes;<\/li><li>Keep it safe and secure;<\/li><li>Keep it accurate, complete and up-to-date;<\/li><li>Ensure that it is adequate, relevant and not excessive;<\/li><li>Retain it for no longer than is necessary for the purpose or purposes;<\/li><li>Give a copy of his\/her personal data to that individual upon request.<\/li><\/ul><p>An individual must apply in writing and simply refer to the Data Protection Act.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9be2f0d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9be2f0d\" data-element_type=\"section\" data-e-type=\"section\" id=\"free-sec12\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-eb025df\" data-id=\"eb025df\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d756cb4 elementor-widget elementor-widget-heading\" data-id=\"d756cb4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">When to use the Data Protection Acts<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ede7fc0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ede7fc0\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-029dab2\" data-id=\"029dab2\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-0a5c43c elementor-widget elementor-widget-text-editor\" data-id=\"0a5c43c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>An individual may use either the Freedom of Information Acts or the Data Protection Acts to access personal information held by public bodies. However, the Data Protection Acts apply only to an individual\u2019s own personal information. Also, the Data Protection Acts apply to all holders of personal information, not just public bodies.<\/p><p><strong>Entitlements under the Data Protection Acts:<\/strong><\/p><ul><li>A decision will, in normal circumstances, issue within one month of receipt of your request;<\/li><li>Details of your entitlement to complain to the Data Protection Commissioner will be included in the decision letter.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
